Conflicting State and Federal Laws May Hinder Pre Employment Screening in North Carolina Nursing Homes


Applicants at home healthcare agencies and nursing homes who committed crimes in other states could slip through the pre employment screening process and get work in North Carolina undetected because of conflicting state and federal laws.
Effective in 2005, a state law requires comprehensive employee background checks on all job applicants at nursing homes, home health care agencies and mental health facilities. However, Federal privacy laws conflict with the new law...
